These Terms & Conditions ("Terms") govern your use of rainco.com.au (the "Site") and any purchase you make from us. By accessing the Site or placing an order, you agree to these Terms. Please read them carefully — if you don't accept them, please don't use our Site.

About us

The Site is operated by RainCo Group Pty Ltd (ABN 90 662 536 441) ("RainCo", "we", "us", "our"), based in Victoria, Australia. You can reach us at hello@rainco.com.au or (03) 9917 4844.

Eligibility

To place an order you must be at least 18 years old and able to enter into a legally binding contract. By ordering, you confirm that you meet these requirements and that the information you provide is true, current and complete.

Using our website

You may use the Site for lawful purposes only. You agree not to:

• misuse the Site, interfere with its operation, or introduce any malicious code;
• attempt to gain unauthorised access to the Site, our systems or any account;
• access the Site other than through the interface we provide, including by scraping, data-mining, or using automated tools or bots; or
• use the Site or its content in any way that breaches these Terms or any applicable law.

We may update, suspend, restrict or withdraw all or any part of the Site at any time, and we do not guarantee that the Site will be available, uninterrupted or error-free.

Your account

If you create an account, you are responsible for keeping your login details secure and for all activity that occurs under your account. Notify us promptly of any unauthorised use. We may suspend or close accounts that breach these Terms.

Products, pricing and availability

• All prices are in Australian dollars (AUD) and include GST unless stated otherwise. A tax invoice is provided with your order.
• We take care to ensure product descriptions, images, specifications and prices are accurate, but errors can occur. Where we identify an error, we may correct it, and we may cancel or decline an order affected by a manifest or pricing error even after it has been placed — see Placing an order below.
• Finishes and colours may vary slightly from how they appear on screen, due to the natural variation of our products and the limits of photography and displays. Such variation is not a defect.
• Products are subject to availability. We may limit quantities, and may withdraw or discontinue any product at any time without notice.

Placing an order

When you place an order, you are making an offer to buy. Any automated acknowledgement confirming receipt of your order is not acceptance. A binding contract is formed only when we accept your order and dispatch the goods (or otherwise confirm acceptance in writing).

We may decline or cancel an order (in whole or in part) at any time before dispatch — for example, where an item is unavailable, a pricing or description error has occurred, we suspect fraud, or we are unable to verify your details. If we cancel an order you have paid for, we will refund the amount paid for the cancelled items. This does not affect your rights under the Australian Consumer Law.

Pre-orders and backorders

Some products may be available to pre-order or on backorder. For these items:

• the dispatch date shown is an estimate only and may change;
• payment is taken when you order to reserve your item; and
• you may cancel a pre-order before it is dispatched by contacting us, and we will arrange a refund.

Payment

Payment is processed securely at checkout through our payment providers (including buy-now-pay-later options such as Afterpay, if you choose one). We do not store your full card details. You must be authorised to use the payment method provided.

Title and risk

Risk in the goods passes to you on delivery. Title (ownership) in the goods passes to you only when we have received payment in full. Until title passes, you must not sell, encumber or deal with the goods in a way inconsistent with our ownership, and we may recover them if payment is not made. For trade and credit customers, this retention of title may constitute a security interest under the Personal Property Securities Act 2009 (Cth) (PPSA), and you consent to us registering it.

Promotions and discount codes

From time to time we may offer promotions or discount codes. These may be subject to conditions (such as minimum spend, eligible products, or an expiry date), cannot be used in conjunction with other offers unless we say so, and may be varied or withdrawn at any time. Codes have no cash value and cannot be applied to past orders.

Delivery

• Delivery timeframes and costs are shown at checkout and are estimates only; we are not liable for delays caused by carriers or events beyond our reasonable control.
• You must provide accurate and complete delivery details. We are not responsible for orders delayed, lost or misdelivered due to incorrect details you have supplied.
• Deliveries may be made on an "authority to leave" basis where permitted; once goods are left at the nominated address, responsibility for them passes to you.
• If delivery fails because no one is available or access cannot be obtained, re-delivery or re-consignment fees may apply.
• Please inspect your order on delivery and report any transit damage, shortage or incorrect item to us as soon as possible (see our Returns Policy and Warranty Terms).

Installation and use of products

Our tapware and fittings must be installed by a licensed plumber (and, where relevant, a licensed electrician) in accordance with the manufacturer's instructions and all applicable Australian Standards and plumbing regulations. Product information on the Site is general guidance only and is not a substitute for professional advice. Incorrect installation, use or care may damage the product and can affect or void your warranty. It is your responsibility to ensure a product is suitable for your intended application before installing it.

Returns, warranty and your consumer rights

Our Returns Policy and Warranty Terms form part of these Terms. Nothing in these Terms excludes, restricts or modifies any rights or remedies you have under the Australian Consumer Law, including the consumer guarantees — those rights apply in addition to anything stated here.

Trade accounts

Trade accounts are offered at our discretion and may be subject to separate trade terms, pricing, credit and application requirements. We may approve, decline, vary or withdraw a trade account at any time. Where separate trade terms apply, they operate in addition to these Terms and prevail to the extent of any inconsistency.

Customer reviews and submitted content

If you submit a review or other content to the Site, it must be genuine, your own, and not misleading, defamatory, offensive, infringing or unlawful. By submitting it, you grant us a perpetual, non-exclusive, royalty-free, worldwide licence to use, reproduce, modify, display and distribute that content in connection with our business, and you consent to us doing so without attribution (to the extent permitted by moral rights law). You warrant you have the rights to grant this licence. We may edit, refuse or remove content at our discretion.

Intellectual property

All content on the Site — including text, images, logos, trade marks, product photography, graphics and design — is owned by or licensed to RainCo and is protected by Australian and international law. You may not copy, reproduce, republish, distribute or use our content for commercial purposes without our prior written permission.

Third-party links

The Site may link to third-party websites or services we don't control. We're not responsible for their content or practices, and linking doesn't imply endorsement.

Limitation of liability

To the maximum extent permitted by law, and subject to your rights under the Australian Consumer Law:

• the Site and its content are provided on an "as is" and "as available" basis, without warranties of any kind;
• RainCo is not liable for any indirect, incidental, special or consequential loss or damage (including loss of profit, loss of use, or property or water damage) arising from your use of the Site or our products; and
• where our liability cannot be excluded but can be limited, our total liability is limited, at our option, to re-supplying the goods or services, or paying the cost of doing so, and in any event will not exceed the amount you paid for the relevant goods.

Nothing in these Terms limits any liability that cannot be excluded under the Australian Consumer Law or other applicable law.

Indemnity

To the extent permitted by law, you agree to indemnify and hold RainCo harmless from any claims, losses, liabilities and costs (including reasonable legal costs) arising from your breach of these Terms, your misuse of the Site, or your unlawful or negligent acts or omissions.

Privacy

We handle your personal information in accordance with our Privacy Policy, which forms part of these Terms.

Events outside our control (force majeure)

We aren't liable for any delay or failure to meet our obligations caused by events beyond our reasonable control — including natural disasters, pandemics, fire, flood, war, industrial action, supply or transport disruptions, or failures of third-party services or utilities.

Changes to these terms

We may update these Terms from time to time. The current version is always available on this page, with its effective date shown. The Terms that apply to your order are those in effect at the time you place it. We recommend reviewing these Terms periodically.

Assignment

We may assign, transfer or subcontract our rights and obligations under these Terms at any time. You may not assign or transfer yours without our prior written consent.

Governing law

These Terms are governed by the laws of Victoria, Australia, and you submit to the non-exclusive jurisdiction of the courts of that State.

General

If any part of these Terms is found to be invalid or unenforceable, the rest continue to apply. Our failure to enforce a term is not a waiver of it. These Terms, together with our Returns Policy, Warranty Terms and Privacy Policy, form the entire agreement between you and RainCo regarding your use of the Site and any purchase you make, and supersede any prior representations or understandings.
